Terms of service

The terms on which GrailDesk is provided

Effective REPLACE_WITH_DATE. Plain words on purpose: where a sentence reads as a promise, it is one.

1. Who we are

GrailDesk is provided by REPLACE_WITH_OWNER_NAME, a sole trader trading as GrailDesk, of REPLACE_WITH_TRADING_ADDRESS, United Kingdom ("we", "us"). Contact: REPLACE_WITH_OWNER_EMAIL. "You" are the person who creates an account. These terms, the privacy notice and the prices page are the whole agreement between us.

2. What GrailDesk is, and is not

GrailDesk is a web application for people who buy and sell trading cards: a ledger that computes profit after fees, postage, packaging, grading and refunds; bankroll rules that warn you before a purchase breaks them; watchlists that scan eBay UK listings and alert you; and billing for the plans on the prices page.

3. Your account

You need an email address, you must be at least 18, and you are responsible for what happens under your sign-in. One workspace per account at launch. Tell us at once if you think someone else has used your account.

4. Plans, prices and payment

5. Cancelling, downgrading and failed payments

6. Your right to cancel under UK consumer law

If you are a consumer, you have 14 days from the day you subscribe to cancel and receive a full refund. Because GrailDesk is digital content and a service supplied at once, we ask you at checkout to agree that we begin straight away and that, by agreeing, you lose the 14-day right once the service has started. If you do not agree, write to us at REPLACE_WITH_OWNER_EMAIL and we will begin your subscription after the 14 days. To cancel within the period where it still applies, email us; a refund is made to the card you paid with within 14 days.

7. eBay's terms (a condition of using GrailDesk)

Listing data shown in GrailDesk comes from eBay's application programming interfaces under eBay's API licence. As a condition of using GrailDesk you agree:

Cached eBay listing data is kept for a limited time only (see the privacy notice) and is never sent to any artificial-intelligence service.

8. Acceptable use

Do not use GrailDesk to break any law or anyone's rights; do not try to get at another workspace's data, to probe, overload or reverse-engineer the service, or to automate access other than through features we provide; do not resell access. We may suspend an account that does, after telling you why where we lawfully can.

9. Your data and ours

Your ledger, watchlists, rules and settings are yours. You can export them as CSV at any time and ask us to delete your account, which removes your workspace and everything in it (see the privacy notice for what we must keep for tax records). The software, its design and its words are ours or our licensors'. You give us the right to process your data only as far as is needed to provide the service.

10. Availability and changes

We aim to keep GrailDesk available all the time but do not promise it; we rely on eBay, Supabase, Vercel, Stripe and Resend, who have outages of their own, and eBay limits how often we may ask it for data. We may change features and these terms; for a change that makes the service materially worse for you we give 30 days' notice by email and you may cancel for a pro-rata refund of any period paid in advance.

11. Liability

Nothing here limits our liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit. Otherwise, we are not liable for loss of profit, loss of a bargain, a buying or selling decision, or a loss that was not foreseeable when you subscribed, and our total liability to you in any 12 months is limited to what you paid us in those 12 months. GrailDesk is provided as described; where you are a consumer your statutory rights are unaffected.

12. Law and disputes

These terms are governed by the law of England and Wales and the courts of England and Wales have jurisdiction, except that a consumer living in Scotland or Northern Ireland may bring proceedings there. If you are unhappy, write to us first; most things can be put right by email.

13. Changes to these terms

The current version is always at this address with its effective date. We will email you about a material change at least 30 days before it applies.
